Terms of Service

These terms govern your use of eWest: the website at ewest.ai, the console, the playground and the API at api.ewest.ai (together, the "Service"), operated by [company legal name], [registered address] ("eWest", "we", "us"). By creating an account or using the Service you agree to them. If you use the Service for an organisation, you accept them on its behalf and confirm that you may do so.

1. The Service

eWest gives you access to third-party and hosted AI models ("Models") for generating text, images and video through one API and console. Models, features and limits may change; we will give reasonable notice before removing a model you have used in the last 30 days, unless its provider withdraws it sooner.

2. Accounts and API keys

  • You must be at least 18 and give accurate account information.
  • You are responsible for everything done with your account and API keys. Keep keys secret and revoke a key you think is exposed.
  • Members you invite to your organisation act on its behalf and can see its usage and request traces.

3. Acceptable use

You must follow our Acceptable Use Policy, which forms part of these terms. You must not resell raw access to the Service or share keys outside your organisation, except as part of your own product that adds substantial functionality.

4. Your content and outputs

You keep your rights in the prompts, images and other material you send ("Input"). As between you and us, you own the results the Models generate for you ("Output"), to the extent the law allows. Outputs may not be unique, and other users may receive similar outputs.

You give us the rights needed to run the Service on your Input and Output: to process them, send them to the Model that serves your request, store them for the periods in our Privacy Policy, and show them to you and your organisation. We do not use your Input or Output to train models.

You are responsible for your Input and for how you use Output, including checking it for accuracy before relying on it.

5. Fees and payment

  • Usage is charged at the prices on our pricing page at the time of the request. Failed generations are not charged.
  • We may require prepaid credit before or while you use the Service, and may pause requests when credit or a key budget runs out.
  • We may change prices with at least 14 days' notice; new prices apply to requests made after they take effect.
  • Prices exclude taxes, which are added where required. Unused prepaid credit is [refund and expiry terms].

6. Availability and changes

We work to keep the Service fast and available but do not guarantee it will be uninterrupted or error-free, unless a separate written service level agreement says so. Models depend on third-party providers whose availability is outside our control.

7. Suspension and termination

You can stop using the Service and delete your organisation at any time. We may suspend or end your access if you breach these terms, fail to pay, create a security or legal risk, or if a provider requires it. Where reasonable, we will tell you first and give you a chance to fix the problem. Sections on content, fees owed, disclaimers, liability and the governing law survive termination.

8. Disclaimers

Except as stated in these terms, the Service and Output are provided "as is". To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. AI output can be inaccurate, offensive or similar to existing works.

9. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. These limits do not apply to liability that cannot be limited by law.

10. Indemnity

You will defend and indemnify us against third-party claims arising from your Input, your use of Output, or your breach of these terms or the Acceptable Use Policy.

11. General

  • These terms are governed by the laws of [governing law], and disputes go to the courts of [venue].
  • We may update these terms. We will give at least 14 days' notice of material changes by email or in the console; continuing to use the Service after that means you accept them.
  • If part of these terms is unenforceable, the rest still applies. These terms, with the policies they reference, are the whole agreement between us about the Service.
